Please read the terms of use carefully

Last updated on: 24-April-2025

IMPORTANT: READ CAREFULLY BEFORE SUBSCRIBING

Before using RADIOBOX HOSTING LLC's services, please read and agree to all usage policies. By contracting our services, you fully accept these conditions, which will be registered in our database.

BRLOGIC is a brand of RADIOBOX HOSTING LLC, and some services may be provided under the BRLOGIC name.

1 - AUDIO STREAMING

Streaming technology enables the transmission of audio over computer networks, eliminating the need to download content beforehand. This allows listeners to access audio in real-time or on-demand, without storing files on their devices.

The process involves a continuous data flow from a server to a decoder, such as a dedicated player, browser plugin, or internet-connected application. This system facilitates immediate content playback, providing a seamless experience for listeners.

1.1 - Live Streaming

To ensure proper transmission, the Client must have a correctly configured computer and updated sound card drivers. If necessary, a sound mixer and other auxiliary equipment should be used.

A stable broadband internet connection (ADSL, cable, or fiber optic) is required for the transmission. RADIOBOX/BRLOGIC is not liable for audio cuts or buffering issues caused by unstable mobile (3G/4G), radio, or satellite connections.

Before starting the transmission, the Client is responsible for verifying their internet connection's speed and stability to confirm it meets the minimum requirements based on the contracted plan's maximum bitrate.

1.2 - Streaming via Auto DJ

All RADIOBOX/BRLOGIC streaming plans incorporate the Auto DJ functionality. This feature enables users to develop bespoke playlists utilizing their uploaded MP3 files, the RADIOBOX/BRLOGIC music repository, and audio library content supplied by partner producers. Client-uploaded file storage is exclusively designated for Auto DJ utilization, with storage capacity being commensurate with the selected plan. Files provided directly by RADIOBOX/BRLOGIC within Auto DJ, encompassing both the audio library and music repository, are excluded from the contracted storage allocation.

1.3 - Additional Services

Additional services will be provided upon subscription to the streaming platform and cannot be used separately. Adherence to the streaming service payment is essential for the provision of additional services, with the exception of the domain, which requires an annual registration separate from the streaming contract.

1.3.1 - Website Builder

All RADIOBOX/BRLOGIC streaming plans incorporates a website builder tailored for radio stations. The selection of themes available within this builder may differ based on the particular plan selected.

1.3.1.1 - Website Hosting

Hosting for the website provided by RADIOBOX/BRLOGIC is included in all plans. The disk space and monthly transfer used by the site are shared with the resources of the contracted streaming plan. If the Client chooses to use their own website, they must host it with a website hosting provider. RADIOBOX/BRLOGIC does not offer hosting services for proprietary websites.

1.3.2 - Domain Name Registration

RADIOBOX/BRLOGIC offers domain name registration at a promotional price for use with its website builder, subject to payment of the fee specified in the subscription form. It's important to note that a domain name is simply the web address for accessing a site, not the website itself.

Domain registration is processed through a partner registrar and typically completed within one business day after payment confirmation. Due to processing times, if the initially chosen domain is unavailable, the Client will be notified and can either select an alternative domain or receive a refund.

Upon ceasing to use the website provided by RADIOBOX/BRLOGIC, the Client has the option to either point the domain to a different provider by updating the domain name servers (upon request) or permanently transfer the domain registration.

RADIOBOX/BRLOGIC reserves the right to refuse domain registration if it determines the domain is not intended for use with its website builder.

The Client assumes full legal responsibility for any misuse of content, trademarks, names, characters, or copyrighted material and agrees to bear all legal consequences, including liability for any related judicial or arbitration proceedings and penalties, as defined by applicable law. Misuse includes any unauthorized use of content that infringes upon third-party rights, whether intentional or negligent.

In the event of arbitration or judicial proceedings arising from the Client's actions, RADIOBOX/BRLOGIC disclaims all liability and will not provide any material, technical, legal, or financial assistance, regardless of the location of the proceedings.

RADIOBOX/BRLOGIC reserves the right to seek recourse if it is required to pay any amount resulting from an action taken by the Client or their representative.

1.3.2.1 - Domain Name Renewal

Domain renewals occur annually and depend on timely payment of the renewal fee. Because a partner registrar handles domain registration, the renewal fee can change due to currency fluctuations and exchange rates at the time of renewal. If the fee isn't paid, the domain registration may expire, and the domain could be lost.

1.3.2.2 - Acceptance of Domain Transfers

Clients can transfer their domain to their RADIOBOX/BRLOGIC account if the TLD is supported and the domain adheres to the current registrar's rules.

To start the transfer, a renewal fee, mandated by the registrar, must be paid. Following payment, the client needs to provide RADIOBOX/BRLOGIC with the transfer code and confirm the domain is unlocked at the present registrar. Once the domain transfer is complete, the renewal fee paid will add an extra year to the registration expiry date held with the previous provider.

1.3.3 - E-mails

To use the email service, the contracted plan must include this feature, and the Client must use the website provided by RADIOBOX/BRLOGIC through their own domain.

Each email account has 1 GB of disk space for message storage, with no upgrade possibility. The number of available email accounts varies according to the contracted plan. This service uses a shared server, and the good conduct of all users is expected to ensure its full operation.

1.3.3.1 - Prohibited practices using our servers

  • SPAM: defined as sending unsolicited emails.
  • Transactional email: automatically sent emails, usually pertaining to a service (password recovery, billing, etc.).
  • Marketing email: newsletter, promoting content, and similar.

Should an infringement occur, the Client will receive a notification, and their email service will be suspended for 24 hours. Repeated infringements will lead to email service cancellation. Once canceled, the email account is unrecoverable, and no backup will be available.

1.3.4 - App

RADIOBOX/BRLOGIC provides applications that may be included in certain plans or purchased separately as an additional service to the contracted plan. Availability for contracting as an additional service may vary according to the adopted commercial policy, requiring prior evaluation and negotiation.

1.3.4.1 - Publishing the Apps

RADIOBOX/BRLOGIC provides three types of applications:

  • Web App (available for Android, iOS & PC users);
  • Android App (available on Google Play).
  • iOS App (available on App Store)

The Web App can be installed on Android, iOS, and PC devices via a compatible browser. Unlike native apps, it does not require app store publication, offering immediate installation without app store validation or bureaucratic delays.

The Android application will be published on the Google Play Store under RADIOBOX/BRLOGIC's developer account, making it available for download on Android smartphones.

For the iOS application, Apple mandates that each client possess their own developer account on the App Store. Consequently, RADIOBOX/BRLOGIC will publish the iOS App directly through the client's provided developer account. The client is solely responsible for the creation, renewal, and maintenance of this App Store developer account, including all associated costs. RADIOBOX/BRLOGIC will only require the account credentials or an invitation to access it for the purpose of application publishing and updates.

Both the App Store and Google Play have specific publication policies. Notably, they prohibit the unauthorized use of copyrighted material and the impersonation of other applications or services.

The App Store and Google Play periodically and unilaterally establish minimum iOS and Android version requirements that applications must meet for initial publication or subsequent updates. These requirements can differ for new and existing applications. RADIOBOX/BRLOGIC will develop the application in accordance with the stores' current requirements.

In certain instances, RADIOBOX/BRLOGIC may need a digitally signed document from the radio station's authorized representative, confirming the contractor's permission to publish an application under their name or brand. In such cases, the app publication process will be temporarily suspended until the requested documentation is provided by the client.

In the event of an application rejection, RADIOBOX/BRLOGIC will leverage its experience and expertise to work with the client to address the necessary requirements. However, successful publication cannot be guaranteed.

Following the application's successful publication, the client has a 30-day period to request necessary adjustments, limited to a maximum of two updates. Any updates requested after this initial period will be subject to separate charges.

1.3.4.2 - Unilateral Removal of Apps

App stores have complete authority over applications and can remove them at any time without warning. Should this happen, RADIOBOX/BRLOGIC will inform the Client to implement the required changes for a new app submission (as deleted apps cannot be restored), if applicable, or explore other solutions if a new app submission is not feasible. App store acceptance is not guaranteed, and any payments made while the app was available are non-refundable.

1.3.5 - Short programs

Short programs, offered in all RADIOBOX/BRLOGIC plans through content producer partnerships, are programs of short duration.

Partner producers are solely responsible for the content of these short programs. RADIOBOX/BRLOGIC is not liable for the quality, accuracy, or any issues arising from the content.

RADIOBOX/BRLOGIC retains the right to discontinue the distribution of any short program at its sole discretion, without any refund.

Short programs are for the Client's radio use only. Distribution, commercialization, or resale are strictly prohibited.

Clients must note content marked for exclusive use in AUTO DJ. This content is restricted to AUTO DJ and cannot be downloaded for live broadcasts. Misuse will result in immediate service cancellation without refund and potential legal action for unauthorized use.

1.3.6 - Voice Assistant

1.3.6.1 - Alexa Skill

An Alexa Skill acts as a voice-activated add-on for Alexa, enhancing its functionality by enabling it to perform new tasks and interact with specific services, much like a plugin.

RADIOBOX/BRLOGIC's Alexa Skill allows users to integrate their radio station into the Alexa ecosystem. Once activated, listeners can use voice commands on any Alexa-enabled device logged into their account, such as Echo smart speakers, to start playing the radio.

Activation of the RADIOBOX/BRLOGIC Alexa Skill is a one-time manual process within the listener's Amazon account.

Please note that the Alexa Skill is a separate, contracted service. The following guidelines and restrictions apply to its publication:

  • A name, logo, and invocation phrase are required. The invocation phrase must be in the Skill's language, free of slang and copyrighted names, and consist of terms recognized by Alexa.
  • Publication in the Amazon store corresponding to the radio's country restricts installation to listeners in that region. For countries without an official Amazon store, publication occurs in the store specified by Amazon's official documentation.
  • Amazon's review team has the sole discretion for approval. Their analysis considers technical aspects, the radio's name, logo, and invocation phrase, including checks for unrecognized terms, legal infringements, and misuse of trademarks or copyrights. Approval for publication is not guaranteed. Our technical team is available to assist with any rejection issues.

1.3.6.2 - RSK

The Radios Skills Kit (RSK), an Alexa feature, serves as a built-in radio directory, enabling users to access radio via voice command without installing a specific skill. To broaden the audience for stations that contract Alexa Skill development, particularly traditional radio stations, RADIOBOX/BRLOGIC may, at its sole discretion and without any extra charge, register and manage the station within the RSK. This aims to enhance the discoverability of these stations.

2 - SUBSCRIPTION

Upon completion of registration, RADIOBOX/BRLOGIC will authenticity of the information. In cases of discrepancies, RADIOBOX/BRLOGIC may either decline the registration or inform the Client for necessary corrections.

Platform access, aligned with the selected plan's features, will only be granted following successful payment. Payment must be made using one of the methods detailed in section "3 - Payment Policies".

3 - PAYMENT POLICIES

Clients are responsible for timely payment of their subscription and any renewals. Payments must be made on the due dates, which are determined by the service activation date.

Subscription fees are prepaid according to the chosen billing cycle: monthly, quarterly, semi-annually, or annually.

Clients contracting our services, whether individuals or legal entities, are responsible for any taxes levied by their respective countries. These taxes are not included in the contracted service fees and are payable by the client where applicable.

The signed contract entails ongoing service delivery contingent upon payment confirmation to ensure uninterrupted continuation.

Payment options vary by the subscriber's location and are confirmed during the sign-up process.

Due to non-payment for any reason, RADIOBOX/BRLOGIC reserves the right to suspend or cancel the Client's service, as non-payment will be interpreted as a lack of continued interest.

The Client retains the option to reactivate the service by settling any outstanding payments at any point prior to cancellation.

3.1 - Suspension

3.1.1 - Streaming Service

After 7 (SEVEN) days of overdue payment, service provision will be immediately interrupted, including access to additional features like website builders and applications, without prior notice.

Access to files, information, emails, the control panel, and other account-related resources may be blocked or suspended. For platform security, passwords may be changed at RADIOBOX/BRLOGIC's discretion.

Service will be reactivated within one business day after the overdue payment is processed by the bank, provided there are no other outstanding debts.

Days of service suspension will not be discounted or compensated in future invoices. RADIOBOX/BRLOGIC is not liable for any data loss resulting from service suspension due to non-payment.

3.1.2 - Domains

Domain names are registered for one year. Failure to renew by the due date will result in automatic suspension by the registrar, making the website and associated services inaccessible.

Renewal is only processed upon payment within the specified timeframe.

RADIOBOX/BRLOGIC cannot intervene in the freezing or release of expired domains, as this is an automated registrar process.

To prevent suspension, domain renewal should be completed at least 7 (SEVEN) days before the expiration date.

3.2 - Credit Card Recurrence

By choosing to pay with a credit card, the Client activates automatic recurring payments for all active contracts within their RADIOBOX/BRLOGIC Account. This means future payments will be processed automatically.

Recurring payments can be turned off at any time via the RADIOBOX/BRLOGIC Account and will be reactivated if the Client makes a new credit card payment.

It's important to note that recurring payments apply to all services under the RADIOBOX/BRLOGIC Account and cannot be managed individually for each service.

When recurring payments are active, automatic billing will occur as per the terms below.

3.2.1 - Streaming Service

Service renewal occurs automatically on the due date, with email confirmation sent. For annual contracts, the next year's total is charged automatically.

If a transaction fails, the client will be emailed and RADIOBOX/BRLOGIC will retry billing. After 7 (SEVEN) days of unsuccessful attempts, services will be suspended without further billing attempts.

To reactivate a suspended service, the client must manually pay through their RADIOBOX/BRLOGIC Account, choosing a new credit card or an option from the "3 - Payment Policies" section.

3.2.2 - Domain Renewal

30 (THIRTY) days before the invoice due date, an email will notify the Client that recurring billing is active and that automatic billing will occur in 20 (TWENTY) days.

10 (TEN) days before the due date, the system will attempt to pay the bill. If the transaction fails, you will receive an email notification. RADIOBOX/BRLOGIC will continue to attempt billing until the domain's due date.

If all attempts fail by the due date, the domain will be FROZEN, and NO further billing attempts will be made. To reactivate the domain, you must manually pay through your RADIOBOX/BRLOGIC account, providing new credit card details or choosing another payment method from section "3 - Payment Policies."

4 - CANCELLATION

4.1 - Streaming Service

Upon canceling the streaming service, all additional services will also be terminated, with the exception of domain registration.

Cancellation of the streaming service and associated services may occur under the following circumstances:

4.1.1 - For non-payment exceeding 30 days

Failure to pay for the streaming service within 30 days after the due date will result in cancellation. Upon cancellation, RADIOBOX/BRLOGIC will permanently delete all data and files associated with the debtor's account without any option for recovery. RADIOBOX/BRLOGIC is not liable for any data loss due to non-payment.

4.1.2 - By Client Request

Upon cancellation request, service access continues until the end of the current paid period. Immediate cancellation can be requested, but no refunds or reimbursements are provided for unused time, including annual subscriptions. Non-use of the service does not release the Client from their obligations under an annual contract.

4.1.3 - For violation of usage policies

RADIOBOX/BRLOGIC retains the exclusive right, upon notification, to terminate service for Clients who breach usage policies, infringe upon third-party intellectual property rights, or violate other rights protected under USA law.

In cases of cancellation due to policy violations, no refunds will be issued.

Furthermore, RADIOBOX/BRLOGIC reserves the right to reject new contracts from individuals or entities associated with accounts that have engaged in infringing activities.

4.2 - Domain

4.2.1 - For lack of renewal payment

Failure to make renewal payment will result in domain cancellation 30 (THIRTY) days after it is frozen.

Please be aware that domain cancellation occurs automatically by the registrar upon expiration, and RADIOBOX/BRLOGIC cannot control this process. A canceled domain cannot be reactivated.

After cancellation, the domain may become available for registration by other parties under the specific rules of each registration entity, without any intervention from RADIOBOX/BRLOGIC.

4.2.2 - By Client Request

The Client may request domain cancellation; however, in this case, only the domain contract with RADIOBOX/BRLOGIC will be canceled. The effective cancellation of the domain will occur automatically, only after its expiration.

5 - BACKUPS

Upon service cancellation, RADIOBOX/BRLOGIC will cease providing the streaming platform, client-entered data, and any additional resources without offering backups. The client bears sole responsibility for backing up all content before service termination.

Termination of the streaming contract also ends the provision of extra services like website builders, emails, short programs, applications, and skills. Data input on the RADIOBOX/BRLOGIC platform cannot be transferred. The client acknowledges their responsibility to perform their own data backups.

6 - UPGRADES

The contracted plan can be changed at any time. RADIOBOX/BRLOGIC will not charge any additional amount for changing from one plan to another, whenever the Client requests it, charging only the proportional value for the change. The requested additional services will be activated only when RADIOBOX/BRLOGIC receives compensation for the initial payment.

7 - PRICE ADJUSTMENTS

Annual price adjustments will be applied to the main streaming plan each year on the subscription date. These adjustments will occur automatically without advance notice.

RADIOBOX/BRLOGIC reserves the right to reassess its fees, beyond scheduled adjustments, with 30 (THIRTY) days' advance notice to the Client. This reassessment can occur at any time to maintain the contract's economic-financial equilibrium due to increases in operational costs, new or modified taxes and tariffs, or any other significant changes impacting RADIOBOX/BRLOGIC's cost structure.

RADIOBOX/BRLOGIC will strive to maintain continuous and fully operational service with the greatest possible uptime. However, we do not guarantee a minimum level of service availability.

Service interruptions may occur without prior notice for critical technical issues. These include situations that threaten the shared server's stability or necessitate security measures to safeguard the network and other clients. Interruptions will be limited to the time needed for resolution.

9.2 - Lost Profits

RADIOBOX/BRLOGIC is independent of any advertisers, sponsors, or partners featured on the Client's streaming platform or website. Consequently, RADIOBOX/BRLOGIC will not be liable for any compensation due to system access instability or failure. The Client remains solely responsible for their advertisers, sponsors, and partners.

RADIOBOX/BRLOGIC advises clients to include clauses in their agreements with advertisers and other third parties that address the potential for service interruptions.

9.3 - Interruptions Due to Excessive Use

High-audience events leading to sudden traffic or usage spikes can interrupt service. To prevent automatic interruptions, the Client MUST notify RADIOBOX/BRLOGIC beforehand, even if their plan includes UNLIMITED resources.

All Clients (including those with plans featuring UNLIMITED characteristics) are in a shared environment and subject to a fair usage policy. This policy ensures service integrity for all users. Excessive or unexpected long-term resource usage may result in temporary blocking or limitations to maintain service quality, integrity, and proper functioning for everyone. In such cases, the plan holder will be notified via a technical support ticket.

RADIOBOX/BRLOGIC is not liable for service interruptions if advance notification has not been provided.

9.4 - Disaster Recovery

RADIOBOX/BRLOGIC employs proactive strategies, such as redundant systems and internal recovery processes, to mitigate risks and maintain platform stability. Nevertheless, events like critical failures, natural disasters, or cyberattacks may occur, and complete data recovery or continuous service cannot be guaranteed.

Clients are responsible for independently backing up critical content for potential restoration. RADIOBOX/BRLOGIC shall not be liable for losses arising from platform unavailability or irreversible system failures.

10 - TECHNICAL SUPPORT

RADIOBOX/BRLOGIC offers technical support solely for the setup and operation of the provided streaming service.

RADIOBOX/BRLOGIC does not provide assistance with the configuration of external hardware like sound mixers and audio interfaces. Similarly, we do not support the installation of audio drivers on the broadcasting computer or the setup and usage of automation software for radio and web radio stations.

11.3 - Custom Widget and HTML Editor

The platform includes an HTML editor in several sections, enabling the integration of external widgets like news feeds, weather updates, and statistical displays. Clients are responsible for using this feature and any consequences it may have on the site's design or performance.

The Client bears full responsibility for all content streamed on the service, including content from RADIOBOX/BRLOGIC, and must cover all associated costs, fees, taxes, and expenses.

The Client warrants that they will handle all legal ramifications of any misuse of copyrighted or intellectually protected content, including trademarks, names, characters, or works. This includes liability for any legal or arbitration proceedings and resulting penalties, according to applicable law. RADIOBOX/BRLOGIC will not be liable for any misuse and will not offer material, technical, legal, or financial support in the event of arbitration or judicial proceedings in any country.

Should RADIOBOX/BRLOGIC be required to pay any amount due to the Client's actions or those of their agents, it reserves the right to seek reimbursement from the Client.

11.4.2 - Account Information

The Client has complete authority over granting access to the administrative interface and bears responsibility for all usage, whether authorized or unauthorized, by external parties. 11.4.4 - Data Breach and Terms and Conditions violation

The Client is aware and agrees that RADIOBOX/BRLOGIC is not responsible for breaches of data stored on its servers resulting from acts of persons authorized by the Client, nor those resulting from criminal or irregular actions of third parties (hackers), beyond the limits of technical predictability at the time they occur, or misuse of the resources made available by the Client themselves.

The Client is responsible for all damages arising from the use of the services and undertakes to indemnify and hold RADIOBOX/BRLOGIC harmless from any legal claim, including losses and damages required by third parties.

RADIOBOX/BRLOGIC reserves the right to suspend the Client's service, at any time, for any reason, without notification or warning, when any infringement or violation of the contract, Brazilian laws, or acceptable use standards is found.

Non-compliance by the Client with any of the obligations provided for in these Terms, without prejudice to the immediate suspension of services as a way to safeguard other Clients, will only lead to termination if the problems cannot be satisfactorily resolved, at RADIOBOX/BRLOGIC's discretion. After suspension, the Client will be informed of the reason for the service interruption, to arrange the technical adaptations enabling reconnection.

Days of service suspension WILL NOT BE DISCOUNTED NOR IN ANY WAY COMPENSATED IN FUTURE BILLINGS.

RADIOBOX/BRLOGIC has a zero-tolerance policy regarding questionable content. Questionable content includes, but is not limited to: sexually explicit material, defamatory, violent, pedophilia, Nazism, racism, fraudulent, and illegal content. This type of content will be moderated by RADIOBOX/BRLOGIC and, once confirmed, the responsible account will be canceled without the possibility of reactivation and without any refund of amounts paid.

11.5 - Authorization for the Use of Trade Name, Trademark, and/or Logo

The Client authorizes RADIOBOX/BRLOGIC to display their trade name, trademark, and/or logo, while this Contract is in force and without any reference to its details, in RADIOBOX/BRLOGIC's list of Clients, website, and advertising materials throughout the national and international territory, without any remuneration being due for such fact.

12 - CONTRACTUAL AMENDMENT

The Client agrees that RADIOBOX/BRLOGIC may unilaterally amend these terms and other documents referred to herein.

If any change is introduced in the usage policies, the amended clauses and conditions will become valid 30 (THIRTY) days after the date of the change.

By continuing to use the service after the amendment of this term takes effect, the Client will be agreeing to it.

RADIOBOX/BRLOGIC will notify the Client whenever any clause of this term of use is changed. Notification will occur through a simple email and/or notice on the platform itself.

It is the Client's responsibility to visit this Term of Use periodically, which will be available on our website at https://en.brlogic.com/contracts/use-terms/streaming and, if they do not agree with any provision, request the cancellation of the service.
